Makuszyńskiego 22/U1, 31-752 Kraków, Poland, registered in the Register of Entrepreneurs kept by the District Court for Kraków - Śródmieście in Kraków, XI Economic Department under KRS no.: 0000518326, REGON: 123179713, NIP: 6783151668, is the Controller of your personal data, and it operates an internet shop at https://exclusivetime.com/ (hereinafter referred to as the “Website”).

3. Processing purpose and basis
for the purpose of concluding and performing an agreement for the provision of electronic services such as the customer account, the internet shop, the Newsletter service and the contact form (basis: Article 6 paragraph 1b GDPR);
• for the purpose of concluding and performing of a sale agreement (basis: Article 6 paragraph 1b GDPR);
• for marketing purposes, based on your express consent (basis: Article 6 paragraph 1a GDPR);
• for analytical purposes by monitoring your activity and that of all other users, including, e.g., keyword searches; optimisation of our services and products based on your comments about them, your interest, the technical logs of the Website, which constitutes our legitimate interest (basis: Article 6 paragraph 1f GDPR);
• for marketing purposes, including direct marketing of our own goods and services offered on the Website or those of our trusted partners, which constitutes our legitimate interest (basis: Article 6 paragraph 1f GDPR);
• for archival (evidence) purposes in order to safeguard information in the event of a legal need to prove facts, which constitutes our legitimate interest (basis: Article 6 paragraph 1f GDPR);
• for the purpose of establishing, exercising or defending legal claims, which constitutes our legitimate interest (basis: Article 6 paragraph 1f GDPR);
• for the purpose of surveying customer satisfaction and determining the quality of our customer service, which constitutes our legitimate interest (basis: Article 6 paragraph 1f GDPR);

4. Data recipients
We may share your personal data with the following categories of entities:
• our subcontractors, i.e., entities whose services we use for their processing, such as accountancy firms, law firms, IT companies, IT service providers, banks, courier companies;
• public authorities, including courts, law enforcement agencies, regulatory bodies, in order to comply with obligations imposed on us by law;
• our trusted commercial partners, whose products complement ours – list available at Partners.

5. Transfer of personal data to a third countries or international organisations.
We shall not transfer your data outside Poland/EU/European Economic Area.

6. Data storage period.
• We keep your data obtained for the purpose of entering into an agreement during agreement negotiations and until the end of the calendar year following the year in which you last contacted us about entering into an agreement;
• We process your data obtained in connection with the conclusion of the agreement until expiry of the statute of limitations for any potential claims arising from the agreement.
• Your basic contact data is stored for marketing purposes until you object to its processing for this purpose, withdraw your consent if we have been processing it on the basis of a marketing consent, or we ourselves determine that it has become obsolete.

7. Your rights:
You have the right to:
a) access your data and obtain a copy of them
b) rectify (correct) your data:
If you notice that your data is incorrect or incomplete.
c) erase data:
If in your opinion there are no grounds for us to process your data, you can request that we erase it.
d) limit the processing of personal data:
If you notice that your data is inaccurate – you may request that we restrict the processing of your data for a period of time to allow us to check the accuracy of the data; your data is unlawfully processed but you do not want it to be deleted; we no longer need your data, but you may need it to defend or assert a claim; or you object to the processing of your data – until it is determined whether the legitimate grounds on our side override the grounds for the objection.
e) object to data processing:
You have the right to object to the processing of your personal data if:
the processing of your personal data is based on a legitimate interest and the objection is justified by your particular situation,
your personal data is processed for direct marketing purposes.
f) to transfer data:
You have the right to receive from us in a commonly used machine-readable format the personal data you have provided to us under the agreement or your consent. Alternatively, you can instruct us to send this data directly to another party.
g) lodge a complaint with a supervisory authority:
If you consider that we are processing your data unlawfully, you may lodge a complaint to the President of the Data Protection Office or any other competent supervisory authority on this matter.
h) to withdraw the consent to data processing:
You have the right to withdraw your consent at any time for those personal data that we process on the basis of your consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Remember, we are required to thoroughly identify you by performing an authentication before exercising your rights.

8. Information on voluntary or obligatory provision of data
We require the following personal data from you in order to be able to conclude and perform the agreement concluded with you and thus provide you with the services available on the Website: first and last name, e-mail address, contact telephone number, delivery address (street, house number, flat number, post code, town, country), residential/business address (if different from the delivery address), IP address. If you are business, we may ask you to additionally provide your company name and tax identification number for invoicing purposes. If you only decide to subscribe to our Newsletter, then we will only need your e-mail address.
The provision of data by you is voluntary and is a condition for the conclusion of the agreement for the provision of electronic services and the sale agreement.
If for any reason you do not provide us with your personal data, we may refuse to conclude an agreement with you, with the consequence that you will not be able to use the Website.
If required by law, we may require you to provide other data necessary, for example, for accounting or tax purposes.
